課程概述

這門課思索國際人權法、原則及標準如何影響我們對健康的想像與闡釋。透過瞭解「健康作為人權」如何被納入或排除自立法、決策及社會運動的過程,我們將探討這個論述的潛力與限制。這門課分為兩大部分:前九週,我們關注健康人權之規範面向,尤其會討論國際人權與憲法基本權之間的關係;後九週,我們則會介紹其實踐面向,找出健康權對所有公民(特別是弱勢及少數群體)的重要性和意義。

This course considers the influence of international human rights law, principles, and standards upon the way in which we imagine and interpret health. We will explore the potential and limits of the discourse of ‘health as a human right’, by considering how it has been incorporated into or excluded from legislative, policymaking, and social movement processes. The course is divided into two parts. In the first nine weeks, we will look at the normative dimension of the intersection of health and human rights, particularly reflecting on the relationship between international human rights and constitutional fundamental rights. As follows, we will turn to its practical dimension, in order to identify the implications of the right to health for all citizens and especially minority communities.

修完課後,學生應能:
•解釋國際人權條約,並瞭解它們如何內化到國內法律體系;
•解釋以人權為基礎之方法,並應用於公共衛生政策之決策;
•分析健康權與其他人權侵害之情況,並提出相關法律主張;
•領會健康之法律、社會與政治決定因素,以參與社會行動。

On completion of the course students should be able to:
•Interpret international human rights treaties and understand how they are internalised into domestic legal systems;
•Explain the human rights-based approach and apply it to public health policymaking;
•Analyse the situations where the right to health and other human rights are violated, and make a legal argument;
•Engage in social activism, by appreciating the legal, social, and political determinants of health. 
課程要求
這門課有兩部分,分別討論「健康作為人權」之規範與實踐面向。對人權或與健康相關社會運動有基本認識,將會很有幫助。修課同學應於課前完成指定閱讀(大部分是法律及政策文件,有時候是學術文獻)。課堂參與及團隊合作是必要的,尤其關於案例分析和倡議設計等活動。

「案例分析」主要為團隊合作,但每位學生皆須基於各組討論,撰寫並繳交自己的摘要(中英文皆可),此部分為個人成績;而言詞辯論,各組選兩名組員上台,其餘組員協助即時查閱資料,此部分為小組成績。

關於「倡議設計」,全組組員皆須分工共同口頭報告;之後各組須繳交一份書面報告,包括議題介紹(不限台灣)、相關法規與政策發展、倡議行動之目標、論述與策略(細節於期中宣布),此作業為小組成績。

The course is divided into two parts, including the normative and practical dimensions of ‘health as a human right’. Basic understanding of human rights and health-related social movements is helpful. Students are expected to do assigned readings – mostly legal and policy documents and sometimes academic texts – prior to lectures. Participation and teamwork are necessary, particularly regarding the activities of case debate and advocacy planning.

‘Case analysis’ requires teamwork, but each student needs to submit their own brief (in Chinese or English) based on the group discussion (individual marks). As for the debate, each group will have two oralists, while other members will work as supporting researchers on site (group marks).

Every group member is required to be part of oral presentation of their ‘advocacy planning’. As follows, they will submit a written report, including the issue concerned (not limited to those in Taiwan), relevant law and policy, and the advocacy’s objectives, arguments, and strategies (group marks).
